Terms of Service

D Real Media LLC

These terms apply to every photo and video booking with D Real Media. When you pay an invoice or check the box agreeing to these terms, you agree to them. If the athlete is under 18, the parent or guardian who books agrees on their behalf.

1. Your Booking

  • Your invoice or booking confirmation lists exactly what you booked: the service, package, dates, add-ons, travel, and total.

  • Your dates are held once your invoice (or deposit) is paid.

  • Game schedules change. If a league moves a game, let me know as soon as you can and we'll move your booking with it.

2. Payment

  • Single games: paid in full at booking.

  • Packs and bundles: paid in full, or in 2 payments: 50% at purchase and 50% within 30 days.

  • Tournament days: a 50% deposit holds your date. The balance is due 48 hours before the event. The deposit isn't refundable, but it moves with you if you reschedule.

  • Media day: the $300 session fee holds your date and isn't refundable, but it moves with you if you reschedule. The final invoice for every player on the roster ($40 each, 10-player minimum) is sent one week before media day and is due before it. Players added on the day are invoiced after.

  • Late payments: if a payment is late, delivery of your reels and photos is paused until the balance is paid.

3. Packs and Bundles

  • 5- and 10-game packs and 6-game bundles must be used within 6 months of purchase. 12-game bundles must be used within 12 months.

  • Siblings in the same family can share a pack or player bundle.

  • Games can be used across basketball, volleyball, and football.

  • Packs and bundles aren't refundable as cash. Unused games can be turned into credit toward a tournament day.

  • Try one game first: if you buy a pack within 2 weeks of a single game, that game counts as the first game of your pack.

  • Bundles: tell me whether a game is photo or video at least 72 hours before it starts. If I don't hear from you, I'll shoot photos. Each bundle must include at least 2 photo games and 2 video games.

4. Cancellations and Reschedules

If the game is cancelled by the league, weather, or the venue, you get full credit toward another date.

If you need to change plans:

  • With 48+ hours notice, reschedule for free. Tournament deposits and media day session fees move with you.

  • With less than 48 hours notice, the game counts as used, and tournament deposits and media day session fees are kept, since that date was held for you.

If I can't make it because of illness, an emergency, or something else outside my control, you choose: reschedule, or a full refund for that booking.

5. Venue Access

  • You're responsible for confirming that the gym, field, or event allows photography and filming.

  • If a tournament requires a media pass, the fee is added to your invoice at cost, with no markup.

  • If the venue doesn't allow me to shoot when I arrive, it's treated as a venue cancellation and you get credit toward another date.

  • Some venues limit where I can stand. I'll get the best angle the venue allows.

6. What I Can and Can't Guarantee

  • I give every game my full effort and attention, but I can't guarantee specific plays, playing time, or angles. If your player is in foul trouble or barely plays, I'll make the best reel or gallery possible from what happened.

  • Creative choices are mine: which moments to use, how the edit flows, color, effects, sound, and whether a reel is horizontal or vertical.

  • Equipment or data loss: if footage or photos are lost because of an equipment failure, you'll get a full refund for the affected game. My total responsibility for any booking is limited to the amount you paid for it.

7. Delivery

  • Video: Game Day and Game Day Plus in 3 to 5 business days; Signature in 5 business days; tournaments in 5 to 7 business days.

  • Photos: private online gallery in 3 to 5 business days; tournaments in 5 to 7 business days; media day within 7 days.

  • Rush delivery is available on some packages for an added fee, as listed on your invoice.

  • Instagram: reels and select photos are posted on @d.real.media, with your player and team tagged when you share their handles.

  • Private option: if you'd prefer nothing is posted publicly, choose the private option on the Parent Consent and Media Release or tell me at booking. Your files will be delivered by private link only.

  • Keeping your files: photo galleries stay online for 60 days. I keep final files for 6 months after delivery and can re-send them during that time. After 6 months, files may be deleted, so please download and save your copies.

8. Revisions

  • Signature video includes one round of revisions. Signature photos include one round of edit requests on your creative edits.

  • Additional rounds, and changes on other packages: $50 per round for video, $25 per round for photos.

  • Revisions are changes to the delivered edit, like swapping a clip or fixing a name. They don't include reshooting a game.

9. Who Owns the Photos and Video

  • D Real Media owns the copyright to all photos and video.

  • Families and players get a personal-use license. You can post, share, print, and use your photos and reels for recruiting, including sending them to coaches and scouts. You can't sell them, use them in paid advertising, or give them to a business for its marketing without my written permission.

  • Teams, clubs, and schools that book team coverage or media day can also use their photos and reels to promote the team, recruit players, and fundraise. They can't resell them or license them to sponsors or other businesses without my written permission.

  • Please don't add filters to, crop out credits from, or heavily edit the photos and reels. Tagging @d.real.media when you post is always appreciated.

  • Unless you choose the private option, I may use photos and video from your booking in my portfolio, website, and social media.

10. Travel

San Diego County is included. Travel outside the county is a flat fee listed on your invoice. Overnight events are quoted separately and include lodging.

11. Safety

I may pause or stop shooting if conditions aren't safe. If I have to leave early for safety reasons, we'll work out a fair credit for the rest of the booking.

12. Changes to These Terms

I may update these terms from time to time. The version in effect when you book applies to your booking.

13. Governing Law

These terms are governed by the laws of the State of California.
